TGRERA orders Jayathri Infra to refund Rs 11 lakh for Gopanpally project

The Telangana State Real Estate Regulatory Authority (TGRERA) has directed the real estate developer Jayathri Infra to refund the entire amount paid by a buyer for a commercial unit in its 'Western Galaxy' project. The commercial complex is located at Gopanpally village in the Serilingampally mandal of Rangareddy district in Telangana.
The regulatory order was issued following a complaint filed by Kolimala Rupa Chandrika, who is a resident of Kancharapalem in Visakhapatnam, against the real estate firm, which operates from its office located in Miyapur.
According to the complaint details, Chandrika entered into a formal memorandum of understanding (MOU) with the developer on June 4, 2021. Under the terms of this agreement, she was to purchase a 200-square-foot commercial space, designated as office number 6/H on the second floor of the Western Galaxy commercial complex in Gopanpally.
The complainant completed the total sale consideration of ₹11 lakh through three separate payments. The first instalment, which was a sum of ₹1 lakh, was paid via UPI on February 5, 2021. The remaining amount was cleared on June 3, 2021, with ₹7 lakh paid in cash and another ₹3 lakh transferred through UPI on the same day.
The developer had assured the complainant that the fully constructed commercial space would be ready and handed over for possession by December 2024. The signed MOU also contained a specific clause stating that, in the event of any delay in delivery, the developer would pay a monthly compensation of ₹50 per square foot until the possession was successfully delivered.
Following the proceedings, TGRERA ordered Jayathri Infra to refund the entire ₹11 lakh paid by the complainant, along with 10.7% annual interest.
