TGHRC Orders Compensation for 18 Cataract Surgery Victims in Hanumakonda

The Telangana Human Rights Commission (TGHRC), headed by Chairperson Dr. Justice Shameem Akther, has recommended monetary compensation for 18 patients who suffered vision loss following botched cataract surgeries at Jaya Hospital in Hanumakonda. The medical procedures were performed at the facility under the state government's 'Kanti Velugu' programme.

Under the commission's recommendations, compensation of Rs. 4 lakh each will be granted to 12 surviving victims, while Rs. 5 lakh each has been recommended for the next of kin of six deceased victims. The panel issued these orders exercising its statutory powers under Section 18 of the Protection of Human Rights Act-1993.

The TGHRC originally took up the suo-motu case following news reports published on September 29, 2018. The published reports alleged that patients had suffered total loss of eyesight due to medical negligence and incorrect treatment during cataract operations at the Hanumakonda facility.

To reach its findings, the commission carried out a detailed enquiry. It examined official reports submitted by the Health Department, medical records provided by the L.V. Prasad Eye Institute, statements from the affected victims and their family members, and official submissions made by Dr. Rajeev K. Reddy Pappuru, an ophthalmologist at the L.V. Prasad Eye Institute.

The comprehensive enquiry revealed severe deficiencies in the maintenance of the hospital's operation theatre. The commission noted critical lapses in hygiene, the use and sterilisation of surgical instruments, infection control procedures, and overall patient safety, alongside a complete failure of oversight by administrative authorities.

The panel observed that the patients contracted a severe Enterobacter Cloacae eye infection, leading to loss of eyesight, prolonged medical treatments, and extensive physical and mental suffering. The commission ruled that such severe negligence directly violated the victims' right to life, health, and human dignity guaranteed under Article 21 of the Constitution of India.

In addition to ordering financial compensation, the commission recommended a detailed enquiry to identify all erring doctors, hospital staff, and concerned administrative authorities to take disciplinary action under applicable regulations. The authorities have been directed to execute the recommendations and submit a formal action-taken report.
