Telangana High Court Refuses to Stay Raidurgam Land Auction

The Telangana High Court has declined to stay the ongoing government auction of lands situated in Raidurgam of Serilingampally mandal in Ranga Reddy district, observing that it would be inappropriate to stall the process through interim orders without absolute clarity on the dispute.
Justice N.V. Shravan Kumar issued the order while hearing a writ petition filed by Ramadevi and others. The petitioners alleged that State officials were interfering with their physical possession of 11.12 acres of land in Survey Numbers 83/1 and 83/Part in Raidurgam. They claimed authorities were using bulldozers to erase boundary markers and sought an immediate halt to the e-auctions scheduled for the 21st and 28th of the month.
Senior Counsel J. Ramachandra Rao, representing the petitioners, argued that the Supreme Court had not invalidated their sale deeds and pointed to a civil court decree in their favour. He contended that following the apex court's verdict on May 7 last year, the matter reverted to the Land Reforms Tribunal (LRT) for re-examination of title claims and land nature, and urged the bench to grant a stay of at least one week.
Opposing the plea, Senior Counsel S. Niranjan Reddy and Additional Advocate General Tera Rajanikanth Reddy, appearing for the State government and the Telangana State Industrial Infrastructure Corporation (TSIIC), submitted that the Supreme Court had clarified that complex disputes over title and possession in Survey Number 83 cannot be decided through writ proceedings under Article 226.
The Additional Advocate General maintained that the lands being auctioned are government properties entirely free of disputes. The counsel argued that determining whether the petitioners' 11.12 acres fall within the disputed 53-acre parcel or the clear government land requires a geographical survey and evidentiary proof before a civil court.
The bench noted there was no evidence of any pending proceedings, issued notices, or review processes initiated before the LRT following the Supreme Court judgment. Refusing to halt the auction, the court directed the respondent authorities to file a detailed counter-affidavit regarding the 11-acre dispute and adjourned the hearing to August 27.
