Telangana High Court Denies Interim Relief to Accused in Adulterated Spices Case

The Telangana High Court in Hyderabad on Friday refused to grant interim relief to Vikas Agarwal and others in a criminal case concerning the manufacture and sale of adulterated spices, directing the police to proceed with their investigation.
Hearing the plea, Justice J. Sreenivas Rao declined to pass interim orders staying the ongoing probe and rejected arguments that law enforcement agencies lacked the authority to register cases related to food adulteration.
The matter reached the High Court after a petition was filed by Vikas Agarwal and others seeking to quash the criminal case registered against them by the police.
Appearing for the petitioners, counsel contended that the police do not possess the legal jurisdiction or authority to register cases involving food adulteration. The counsel argued that such offences fall exclusively under specialized statutory frameworks rather than general police jurisdiction.
Additionally, the petitioners' counsel submitted that the primary petitioner was not present at the specific premises where the police conducted their search operations. The counsel asserted that the petitioner had been implicated in the criminal case solely based on a confession or statement made by a co-accused while in police custody.
Strongly opposing the petition, Public Prosecutor Palle Nageswara Rao argued that law enforcement authorities are actively conducting targeted raids and booking cases to curb the widespread issue of food adulteration across the region.
The Public Prosecutor emphasized the severe consequences of such offences, stating that adulterated spice ingredients produced by organized syndicates ultimately reach household kitchens and pose extensive risks to public health. He argued that granting interim protection or halting the investigation at this stage would send a wrong message to society and encourage fraudulent activities that jeopardize public safety.
After considering the submissions from both sides, Justice Sreenivas Rao refused to grant any interim relief to the petitioners. The court instructed the police to continue their investigation into the matter. Furthermore, the High Court directed the authorities to file a comprehensive counter-affidavit and adjourned the proceedings for further hearing.
